1. Scope

These Terms & Conditions apply to all purchases made through the online shop of:

They apply to purchases of original artworks and other products offered through this website.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A business customer is a natural or legal person or partnership acting in the course of its commercial or self-employed professional activity.

2. Artwork & Product Information

All original artwrks are individually created by Christina Anna Sperber.

Every effort is made to represent colours, textures, materials and proportions as accurately as possible. However, slight differences may occur due to screen settings, lighting and the individual characteristics of handmade artworks.

Dimensions, materials, framing and other relevant details are stated on the individual artwork page.

Unless otherwise stated, each original artwork is unique and signed, titled and dated on the reverse and accompanied by a certificate of authenticity.

3. Conclusion of Contract

The presentation of artworks in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By completing the checkout process and submitting the order, you make a binding offer to purchase the selected artwork.

The purchase contract is concluded when the order is accepted by confirmation email or the artwork is dispatched, depending on the checkout process used.

The contract language is English.

4. Prices & Payment

All prices are displayed in the currency shown in the online shop.

Where applicable, prices include statutory VAT.

Shipping is included in the listed price of original artworks unless expressly stated otherwise on the individual product page.

Any import duties, local taxes, customs fees or similar charges arising in the destination country are not included and are the responsibility of the recipient.

Available payment methods are displayed during checkout.

Payment is due at the time of purchase unless otherwise expressly agreed.

5. Shipping & Delivery

Germany

Original artworks delivered within Germany are shipped stretched and framed, as specified in the individual artwork description.

Shipping within Germany is included in the artwork price.

EU & International

For deliveries outside Germany, original artworks are generally shipped unstretched and unframed, carefully rolled and protected in a shipping tube.

This is considered the safest and most efficient way to transport larger original artworks over longer distances.

Rolled shipping is included in the artwork price.

If stretched or framed delivery outside Germany is requested, this may be arranged separately where possible and may result in additional shipping and handling costs. Please contact the studio before purchasing to discuss this option.

Estimated delivery times are provided for guidance only. Delays caused by customs procedures, carriers or circumstances outside the studio's reasonable control may occur.

6. Customs, Import Duties & Taxes

Orders shipped outside the European Union may be subject to import duties, taxes, customs clearance fees or other charges imposed by the destination country.

These charges are not included in the purchase price and are the responsibility of the recipient.

The studio has no control over these charges or the time required for customs clearance.

Customers are responsible for checking the applicable import requirements in their country before placing an order.

7. Right of Withdrawal & Returns

Consumers are entitled to the statutory right of withdrawal where applicable.

Detailed information regarding the withdrawal period, procedure, consequences of withdrawal, return costs and the model withdrawal form can be found on the separate Right of Withdrawal page.

Nothing in these Terms & Conditions limits any mandatory statutory consumer rights.

Commissioned & Personalised Artworks

The statutory right of withdrawal does not apply to artworks that are made to the customer's individual specifications or are clearly personalised, where the requirements for the statutory exclusion are met.

This applies in particular to commissioned artworks created specifically according to an individual collector's requirements.

The German statutory exception for individually made or clearly personalised goods is contained in § 312g(2)(1) BGB.

8. Damaged or Defective Artwork

Please inspect your artwork upon delivery.

If an artwork arrives visibly damaged, please contact studio@christinaannasperber.com as soon as possible and provide photographs of the artwork, packaging and visible damage.

Please retain the original packaging until the matter has been resolved, as it may be required for a transport or insurance claim.

Requests to report transport damage promptly do not limit the customer's statutory rights regarding defective goods.

German law generally provides consumers with statutory rights when purchased goods are defective; contractual terms cannot simply eliminate these mandatory consumer protections.

9. Retention of Title

The artwork remains the property of Christina Anna Sperber until payment has been received in full.

10. Copyright & Intellectual Property

The purchase of an original artwork transfers ownership of the physical artwork only.

All copyrights and intellectual property rights relating to the artwork remain with Christina Anna Sperber unless expressly agreed otherwise in writing.

Purchasing an artwork does not grant the purchaser the right to reproduce, copy, commercially exploit, distribute, publish or create derivative works from the artwork.

Images of the artwork may not be used for commercial purposes without prior written permission.

This is particularly important for you because selling the physical original does not itself transfer your copyright. German copyright law distinguishes ownership of the physical work from copyright and usage rights.

11. Certificates of Authenticity

Where specified, original artworks are supplied with a certificate of authenticity.

The certificate forms part of the documentation of the artwork and should be retained by the collector.

12. Commissions

Commissioned artworks may be subject to additional individual terms concerning dimensions, materials, price, deposit, completion timeframe, revisions and delivery.

These terms will be communicated and agreed upon before work on the commission begins.

Due to the handmade and intuitive nature of the artistic process, commissioned artworks will not constitute exact reproductions of existing works unless expressly agreed otherwise.

13. Liability

Liability is governed by the applicable statutory provisions.

Nothing in these Terms & Conditions excludes or restricts liability where such exclusion or restriction is prohibited by law, including liability for injury to life, body or health or liability based on intent or gross negligence.

14. Governing Law

These Terms & Conditions and the contractual relationship are governed by the laws of the Federal Republic of Germany.

For consumers, this choice of law does not deprive them of mandatory consumer protection provisions applicable under the law of the country in which they have their habitual residence where such provisions apply.
