RIGHT OF WITHDRAWAL

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, receives the artwork.

To exercise your right of withdrawal, you must inform:

of your decision to withdraw from the contract by means of a clear statement, for example by email or letter.

You may use the model withdrawal form provided below, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, I will reimburse all payments received from you, including the costs of standard delivery, without undue delay and no later than fourteen days from the day on which I receive notification of your withdrawal.

If you expressly selected a type of delivery other than the least expensive standard delivery offered, additional delivery costs will not be reimbursed.

The reimbursement will be made using the same means of payment used for the original transaction unless expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.

I may withhold reimbursement until I have received the artwork back or until you have provided evidence that you have returned it, whichever occurs first.

These rules reflect § 357 BGB, including reimbursement of standard outbound delivery costs and the right to withhold reimbursement until the goods or proof of return have been received.

Returning an Artwork

You must return or hand over the artwork without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal.

The deadline is met if you send the artwork before the fourteen-day return period has expired.

You are responsible for the direct costs of returning the artwork.

Due to the size, value and delicate nature of original artworks, please contact studio@christinaannasperber.com before arranging the return so that suitable packaging and transport can be coordinated.

Where an artwork was originally delivered rolled, it should be returned securely rolled and protected in appropriate packaging.

Where an artwork was delivered stretched and/or framed, it must be securely packaged for return transport.

The customer may legally be made responsible for the direct return costs if they are informed of this in advance.

Loss in Value

You are only liable for any diminished value of the artwork resulting from handling beyond what is necessary to establish the nature, characteristics and condition of the artwork.

Exclusion from the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and are made according to an individual choice or specification of the customer, or that are clearly personalised to the customer's individual needs.

This may include commissioned artworks created specifically according to a collector's individual specifications.

Das ist für deine Commissions wichtig. Die Ausnahme ergibt sich aus § 312g Abs. 2 Nr. 1 BGB. Ein bereits existierendes Original wird dagegen nicht allein dadurch zur Sonderanfertigung, dass es ein Unikat ist.
